A complaint is the legal document that you will ultimately file with the court against the negligent party if you are not able to settle the matter with the negligent party’s insurance carrier. This must be timely filed within the applicable statute of limitations and in the appropriate court.

Many clients believe that the complaint is filed against the negligent party’s insurance company. This is not true in Arizona. Although the referenced insurance company is not a named defendant in the complaint, the insurance company has a contractual obligation to indemnify its insured (the negligent party) concerning any judgment you obtain against the insured up to its insured’s policy limits. Furthermore, the negligent party will be represented by an attorney hired by the insurance company.
